Look, this is a free country, and there’s no law that says you have to keep suing Apple for alleged antitrust after you start. But after X Corp. and SpaceXAI withdrew such a suit earlier this week, the judge in the case simply needs to know why.

The lawsuit reportedly argues that the leading AI companies violated antitrust laws when they agreed to coordinate slowdown efforts, and that doing so would reduce the value consumers get for paid AI subscriptions.

X Corp and SpaceXAI permanently dropped their antitrust claims against Apple, but their case against OpenAI continues after a judge rejected access to the confidential deal.

The lawsuit arrived at the height of Musk’s long-running feud with OpenAI CEO Sam Altman. Earlier this year, a jury sided with OpenAI in a separate lawsuit Musk filed over the company’s shift away from its original nonprofit structure, finding that Musk had waited too long to sue.
